1. Acceptance of Terms

By accessing and using the Mexico Bariatric Center website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this site and services.

The term “Mexico Bariatric Center”, “MBC”, “we”, “us” and “our” refers to Mexico Bariatric Center.

2. Medical Services

Our services include:

  • Medical consultations and evaluations
  • Bariatric surgery procedures in Mexico
  • Travel coordination and support
  • Post-operative care and follow-up

All medical procedures are performed by licensed physicians in COFEPRIS-accredited facilities in Mexico. While we facilitate the process, the medical relationship is between you and the healthcare providers in Mexico.

In accordance with NZ Medical Council guidelines:

  • All medical advice is provided by qualified healthcare professionals
  • We maintain clear records of all medical consultations and decisions
  • We follow strict protocols for sharing medical information
  • We ensure informed consent for all procedures

3. Financial Terms

Financial arrangements comply with NZ regulations:

  • All prices are in NZD unless otherwise stated
  • Payment terms and schedules will be provided in your treatment plan
  • KiwiSaver withdrawal is subject to approval by your provider
  • Refund policies will be detailed in your service agreement

KiwiSaver Early Withdrawal:

  • Applications must meet the "significant financial hardship" or "serious illness" criteria
  • Supporting medical documentation will be provided
  • We can assist with the application process but cannot guarantee approval
  • Consider seeking independent financial advice before proceeding

4. Medical Travel

You acknowledge that:

  • Medical travel involves inherent risks
  • You are responsible for obtaining proper travel insurance
  • You must comply with all travel requirements and restrictions
  • We are not liable for travel-related issues beyond our control

Travel Safety Measures:

  • 24/7 emergency support during your stay
  • Direct transfers between airport, accommodation, and medical facilities
  • Assistance with travel documentation and requirements
  • Coordination with local medical teams

5. Patient Rights and Responsibilities

Under the Code of Health and Disability Services Consumers' Rights:

  • Right to be treated with respect
  • Right to freedom from discrimination, coercion, harassment, and exploitation
  • Right to dignity and independence
  • Right to services of an appropriate standard
  • Right to effective communication
  • Right to be fully informed
  • Right to make an informed choice and give informed consent
  • Right to support

Your responsibilities include:

  • Providing accurate medical history and information
  • Following pre and post-operative instructions
  • Attending scheduled appointments and follow-ups
  • Maintaining open communication with healthcare providers

6. Limitation of Liability

While we strive to provide accurate information and quality services, we cannot guarantee specific outcomes. Individual results may vary, and all surgical procedures carry inherent risks.

We are not liable for:

  • Surgical complications or unexpected medical outcomes
  • Travel-related issues or delays
  • Actions or omissions of third-party providers
  • Force majeure events

This limitation of liability does not affect your rights under the Consumer Guarantees Act 1993 or other applicable New Zealand laws.

7. Governing Law

These terms are governed by New Zealand law. Any disputes shall be subject to the exclusive jurisdiction of New Zealand courts. These terms comply with:

  • Fair Trading Act 1986
  • Consumer Guarantees Act 1993
  • Health and Disability Commissioner Act 1994
  • Privacy Act 2020
